In an inter partes examination of a patent directed to using hypoxic compositions for preventing and extinguishing fires, the USPTO Patent Trial and Appeal Board's dismissal of appellant's cross-appeal for lack of jurisdiction is vacated where the Examiner incorrectly refused to consider proposed rejections to newly-added claims after reexamination had been instituted.
