Lighting Ballast Control LLC v. Philips Electronics North America Corp., 12-1014
In an infringement action involving a patent directed at electrical lighting, on remand from the US Supreme Court, the Federal Circuit's previous ruling regarding claim construction is affirmed even in light of the ruling in Teva Pharmaceuticals USA, Inc. v. Sandoz, Inc., 574 U.S. ___, 135 S. Ct. 831 (2015), which held that while the ultimate question of the proper construction of a claim is a legal question that this court reviews de novo, there may be underlying "subsidiary" factual findings by the district court related to the extrinsic record that are reviewed for clear error.
