Shire Development, LLC v. Watson Pharms., Inc., 13-1409

On remand from the US Supreme Court and in light of its decision in Teva Pharmaceuticals USA, Inc. v. Sandoz, Inc., 135 S.Ct. 831 (2015), which clarified how this court should review a district court's construction of a claim term, in an infringement case involving a patent that claims a controlled-release oral pharmaceutical composition for treating inflammatory bowel disease, the district court's constructions of the disputed claim terms and subsequent findings of infringement are again reversed where this case does not involve factual findings to which deference is owed under Teva.
