Schaeffler Group USA, Inc. v. US, 12-1269
The Court of International Trade's dismissal of an action bringing a Fifth Amendment Due Process challenge to the Continued Dumping and Subsidy Offset Act of 2000 (CDSOA), which provided for the distribution of anti-dumpting duties collected by the US to affected domestic producers (ADPs), is affirmed where Congress had a rational basis for the retroactive application of the petition support requirement of the CDSOA.
