In an infringement action involving patents that share a specification and have identical lone claims directed toward a specific type of steel sheet that has very high mechanical resistance after thermal treatment, the district court's grant of summary judgment to defendant finding invalidity is: 1) affirmed as to invalidity of claims 1-23 of the patent where they were broadened after two years of issuance in violation of 35 U.S.C. section 215; and 2) reversed as to newly added claims 24 and 25, which were not broadened during reissue.
