Pat Huval Restaurant & Oyster Bar, Inc. v. International Trade Commission, 12-1250
In a case challenging the constitutionality of the Continued Dumping and Subsidy Offset Act of 2000, 19 U.S.C. section 1675c(a) (2000), known as the CDSOA or "the Byrd Amendment," the Court of International Trade's rejection of the constitutional attack is affirmed where the retroactive application of the Byrd Amendment does not violate due process.
