In an action to enjoin a pharmaceutical company from continuing its launch of Mitigare, a colchicine product for prophylactic treatment of gout, and from launching an authorized generic version of Mitigare, the district court's denial of motion for preliminary injunction is affirmed where it did not abuse its discretion in denying a preliminary injunction on the ground that plaintiff had failed to meet its burden to show a likelihood of success on the merits.
