United States Federal Circuit
SUFI Network Services v. US, 14-5032
In a dispute in which the Air Force breached a contract with plaintiff-telephone network provider and then failed for six months to respond to plaintiff's claim for attorney fees, the Court of Federal Claims judgment in favor of plaintiff is: 1) affirmed in part where a) the Air Force contracting officer's delay in responding to the claim for attorney fees excused plaintiff's failure to exhaust remedies, and b) attorney fees were properly awarded; but 2) vacated in part as to the trial court's award of interest.
