Toomer v. McDonald, 14-7045
In an action by a veteran to secure benefits for his back injury that was purportedly connected to an in-service injury, the Veterans Court's dismissal of the appeal as untimely is affirmed where the 120-day limit was exceeded and the Court has no jurisdiction to review factual findings of the Veterans Court absent a constitutional challenge.
