Oplus Technologies, Ltd. v. Visio, Inc., 14-1297
In a patent infringement suit, the district court's denial of attorneys' and expert witness fees, under 35 U.S.C. section 285, 28 U.S.C. section 1927, is vacated where the court abused its discretion in denying fees, because the court found evidence of Oplus's litigation misconduct and the case is exceptional, and it must articulate the reasons for its fee decision.
