In this pre-award bid protest appeal, plaintiff challenges the payment terms of requests for quotes (RFQs) issued by the United States Department of Health and Human Service's Centers for Medicare and Medicaid Services. Plaintiff alleges that the payment terms violate certain statutory and regulatory provisions, while defendant asserts that plaintiff did not have standing to bring its bid protest because it did not qualify as an "interested party." The judgment of the Court of Federal Claims in favor of the Government is reversed and remanded, where: 1) plaintiff qualified as an "interested party" within the meaning of 28 U.S.C. section 1491(b)(1) at the time it filed its bid protest; and 2) the Court of Federal Claims erred in holding that the payment terms do not violate the applicable regulations.
