Pacing Technologies v. Garmin International, 14-1396
In this patent infringement case involving plaintiff's '843 patent, which is directed to methods and systems for pacing users during activities that involve repeated motions, such as running, cycling, and swimming, the district court granted summary judgment in favor of defendants on grounds that defendants' accused products do not infringe the asserted claims of the '843 patent. The judgment is affirmed, where: 1) there is no genuine dispute of material fact as to whether defendants' devices produce a sensible tempo, and merely displaying the rate of a user's pace does not produce a sensible tempo; and 2) therefore, defendants' accused devices are not repetitive motion pacing devices.
