Soverain Software v. Victoria’s Secret Direct Brand Management, 12-1649

Judgment of the district court finding that defendants infringed various asserted claims of plaintiff’s ‘492 and ‘314 patents, and finding that those claims were not invalid, is reversed, where: 1) after the district court’s judgment, this court decided Soverain Software v. Newegg, in which the same asserted claims as here were held invalid as obvious; 2) issue preclusion applies as a result of the Newegg case; and 3) the asserted claims here are therefore invalid.
