Dongtai Peak Honey Industry Co, Ltd. v. US, 2014-1479
In an appeal of an antidumping duty order imposed on honey imported from China, the Court of International Trade's denial of Motion for Judgment on the Agency Record is affirmed where: 1) the Dept. of Commerce properly exercised its discretion in denying petitioner's untimely filings; and 2) Commerce's decision to treat petitioner as part of the China-wide entity and to impose a dumping margin based on adverse facts available were supported by substantial evidence and were in accordance with law.
