Higbie v. US, 14-5042

Dismissal of plaintiff's claim for money damages against the United States Government for alleged breach of a confidentiality provision in an alternative dispute resolution agreement is affirmed, where: 1) the Court of Federal Claims did not err in requiring plaintiff to show that the mediation agreement could be fairly interpreted to contemplate money damages because non-monetary relief was available; 2) plaintiff failed to make the required showing; and 3) the Court of Federal Claims therefore lacked jurisdiction under the Tucker Act and properly dismissed plaintiff's claim.
