Fleming v. Escort, Inc., 14-1331

In this patent infringement case, the district court's judgment upholding the jury verdict concerning two reissue patents, in which the jury found for plaintiff on infringement and validity as to most of the asserted claims but invalidated five claims, is affirmed, where: 1) there was sufficiently specific factual support for the invalidity determinations; 2) the evidence presented here sufficiently makes credible the testimony of the purported prior inventor with regard to conception and reduction to practice of the invention as claimed; 3) the evidence does not warrant an inference of abandonment, suppression, or concealment; and 4) defendant Escort's challenge on cross-appeal is meritless.
