United States Federal Circuit

Stryker Corporation v. Zimmer, Inc., 13-1668

In this patent litigation, judgment finding that plaintiff Stryker's patents were valid and were willfully infringed by defendant Zimmer is affirmed as to the jury's findings that the patents were valid and infringed by Zimmer, but reversed as to the judgment that the infringement was willful, where Zimmer's defenses to the infringement of each patent claim that Stryker asserted were not objectively unreasonable, and it therefore did not act recklessly in the face of objectively-defined risk.
