United States Federal Circuit
Promega Corp v. Life Tech, 13-1011
In this patent litigation, summary judgment against defendant LifeTech finding that the asserted claims of plaintiff Promega's '660, '235, and '771 patents, which relate to multiplex amplification of STR loci, are not invalid for lack of enablement and obviousness, and judgment as a matter of law (JMOL) finding that defendant's accused products do not infringe either the Promega or Tautz patents, are reversed and the jury's damages award is vacated, where: 1) the challenged claims of the Promega patents are invalid under 35 U.S.C. section 112 for lack of enablement; 2) substantial evidence supports the jury's finding that LifeTech infringed the Tautz patent under 35 U.S.C. sections 271(a) and 271(f)(1); and 3) the challenged claims of four of the five asserted patents on which the jury based its damages verdict are invalid.
