United States Federal Circuit
Memorylink Corp. v. Motorola Solutions, 14-1186
In this case involving patent infringement, breach of contract, and various tort claims, summary judgment in favor of defendant on the contract and patent infringement claims and dismissal of the various tort claims is affirmed, where: 1) the district court properly dismissed the tort claims on grounds that they were barred by the statute of limitations, as, more than five years before it filed suit, plaintiff knew all the facts necessary to assert its claims; 2) there was proper consideration supporting the patent assignment; and 3) there is no genuine issue of material fact as to the patent infringement claim because there was a valid assignment.
