In this patent infringement case involving a device with a microphone and a removable, interchangeable flash memory recording medium that allows for audio recording and playback, judgment of non-infringement is affirmed in part, reversed in part, and remanded for further proceedings, where: 1) the district court correctly applied collateral estoppel to the '774 patent; and 2) the district court erred in applying collateral estoppel to the '108 patent, as the '108 patent and the '774 patent are unrelated, and therefore the '108 patent requires an independent claim construction inquiry.
