Azure Networks v. CSR, 13-1459
In this patent infringement action involving the '129 patent, which describes a network for wireless communications between a central hub device and surrounding peripheral devices, judgment of noninfringement is vacated and remanded, and dismissal of plaintiff Tri-County is affirmed, where: 1) Tri-County lacks standing to bring or join the suit, as, pursuant to the agreement between Tri-County and plaintiff Azure, all substantial and exclusionary rights in the '129 patent were transferred from Tri-County to Azure; and 2) the district court improperly construed the term "MAC address" in the '129 patent as "a device identifier generated by the hub device" and not "an address that uniquely identifies a device or group of devices on a shared communication medium."
