United States Federal Circuit

Halo Electronics v. Pulse Electronics, 13-1472

In this patent infringement action, summary judgment in favor of defendant Pulse is affirmed, where: 1) because Pulse did not sell or offer to sell within the United States those accused products that Pulse manufactured, shipped, and delivered outside the United States, there was no direct infringement of plaintiff Halo’s patents by those products; and 2) though certain accused products by Pulse were sold and delivered in the United States, these were imported into the United States by others, and as such, any infringement was not willful.
