Benefit Funding Systems v. Advance America Cash, 14-1122
Stay of patent infringement litigation pending covered business method (CBM) review of the asserted claims relating to a system and method for enabling beneficiaries of retirement benefits to convert future benefits into current resources to meet current financial and other needs and objectives, is affirmed, where: 1) the only real argument against a stay concerns the authority of the Patent Trial and Appeal Board to conduct the CBM review, and circumstances are sufficient for the district court to conclude that the first and fourth factors of America Invents Act section 18(b) favor staying the case; and 2) plaintiffs present no other basis for challenging the conclusion that the second and third factors also favor a stay.
