United States Federal Circuit

buySAFE, Inc. v. Google, Inc., 13-1575

In this patent suit involving claims directed to creating familiar commercial arrangements by use of computers and networks, judgment on the pleadings in favor of defendant is affirmed, where: 1) under the approach to 35 U.S.C. section 101 affirmed by SCOTUS in Alice Corp. Pty. Ltd. v. CLS Bank Int'l, the asserted claims are invalid because they cover subject matter ineligible for patenting; and 2) the claims' invocation of computers adds no inventive concept, as a computer receiving and sending information over a network with no further specification is not arguably inventive.
