United States Federal Circuit

Veridyne Corporation v. US, 2013-5011

In an action brought by plaintiff to recover on its contract with the government, the Court of Federal Claims' decision awarding plaintiff partial recovery under a quantum meruit theory, but also awarding penalties to the government is: 1) reversed in part as to the Claims Court's quantum meruit award to plaintiff, where it was improper for the Claims Court to allow plaintiff to recover in quantum meruit when its claims have been forfeited under the Special Plea in Fraud Statute; but 2) affirmed in part, with regard to the award of penalties to the government under the False Claims Act and Contract Disputes Act.
