Summary judgment that defendant does not infringe the asserted claims of plaintiff's '267 patent and '427 patent, which describe and claim an improvement to a Code Division Multiple Access (CDMA) system, is affirmed, where: 1) plaintiff's submissions during prosecution of its stipulated construction for the term preamble constitute disclaimer; 2) the district court properly granted summary judgment of noninfringement; and 3) the district court properly refused to grant the relief plaintiff requested in its motion for reconsideration.
