Digitech Image Technologies v. Electronics For Imaging, Inc., 13-1600

In a patent infringement action involving plaintiff's '415 patent, which is directed to a device profile and a method for creating a device profile within a digital image processing system, the district court's conclusion that the asserted claims were invalid, is affirmed, where: 1) the device profile described in the '415 patent is not a tangible or physical thing and thus does not fall within any of the categories of eligible subject matter; and 2) the process described in the asserted claims is directed to an abstract idea and is not patent eligible under 35 U.S.C. section 101.
