The district court's judgment in favor of defendant and conclusion that the Board of Patent Appeals and Interferences properly cancelled the claims of plaintiff's '451 patent in an interference proceeding with defendant, are vacated and remanded, where the district court erred in refusing to consider evidence pertinent to the determination of priority.
