Summary judgment in favor of defendant in an action in which plaintiff alleges that defendant's smartphone application infringed claims 9 and 17 of plaintiff's '955 patent, is affirmed, but modified, where: 1) the district court correctly held claim 17 invalid but erred to the extent it held corrected claim 9 invalid; and 2) this lawsuit involves only uncorrected claim 9.
