Virtualagility Inc. v. Salesforce.com, Inc., 2014-1232

The district court's order denying defendants' joint motion to stay plaintiff's patent infringement lawsuit against defendants pending post-grant review of the validity of plaintiff's asserted claims under the Transitional Program for Covered Business Method Patents (CBM program), is reversed, where: 1) three of the four factors weigh heavily in favor of a stay in this case: simplification of the issues and streamlining of the trial, whether discovery is complete and a trial date has been set, and reduction of the burden of litigation on the parties and the court; 2) the undue prejudice factor, at best, weighs slightly in favor of denying a stay; and 3) on this record, we conclude that the district court abused its discretion when it denied the stay.
