Abbvie Deutschland GmbH & Co. v. Janssen Biotech, Inc., 13-1338
In a patent infringement action and a patent interference action, judgments of invalidity of the asserted claims plaintiff's patents related to antibodies that are useful for treating diseases, are affirmed, where: 1) defendant Centocor was not collaterally estopped from raising invalidity defenses in the infringement action after the interference proceeding at the PTO; 2) record evidence sufficiently supported the jury verdict that the asserted claims lacked adequate written description; and 3) there was no reversible error in the contested evidentiary rulings and jury instructions relating to the issue of written description sufficient to warrant a new trial.
