Vaillancourt v. Becton Dickinson & Company, 2013-1408

An appeal brought by plaintiff challenging the decision of the Patent Trial and Appeal Board that rejected all thirty-seven claims of the '221 patent, is dismissed, where: 1) plaintiff is not the owner of the '221 patent because he assigned the patent during the pendency of the proceedings; and thus, 2) he cannot bring this appeal before the court, for lack of a cause of action.
