Bowers v. Shinseki, 2013-7087

In an action seeking benefits based on the military service of plaintiff's late husband, who served in the Army National Guard, the US Court of Veteran's Claims denial of benefits is affirmed where it properly concluded that plaintiff's husband was not a veteran, as defined by statute, and therefore not qualified for the regulatory presumption of a service connection for any veteran who develops ALS after active military service.
