Trebro Manufacturing, Inc. v. Firefly Equipment, LLC, 2013-1437

The district court's order denying plaintiff's motion for a preliminary injunction against defendants for infringement of plaintiff's patent related to sod harvester technology is vacated and remanded, where the district court abused its discretion in denying the motion because it erred in finding that: 1) plaintiff failed to prove a likelihood that defendant infringes the patent; 2) defendant raised a substantial question of the patent’s validity; and 3) plaintiff failed to prove a likelihood of irreparable harm.
