In Re: Teles AG Information, 2012-1297
The Board of Patent Appeals and Interferences properly affirmed the Patent and Trademark Office's rejection of claim 35 of plaintiff's patent on a method and apparatus for transmitting data in a telecommunications network, where: 1) the district lacked jurisdiction but erred in dismissing the case, when it should have transferred it; and 2) treating the case as transferred to this court, the Board properly rejected claim 35 as obvious.
