Endo Pharmaceuticals Inc. v. Actavis, Inc., 2013-1658
The district court's order denying plaintiff's motions for a preliminary injunction to prevent defendants from marketing and selling their respective generic drug versions of of Opana® ER, a painkiller, during the pendency of this litigation, is vacated and remanded, where: 1) the district court erred in concluding that defendants had an implied license to practice the asserted patents; and 2) defendants do not have an express license.
