Biggers v. Navy, 2013-3059
A decision of the Merit Systems Protection Board sustaining petitioner's indefinite suspension by the Department of the Navy and holding that petitioner was not entitled to back pay in connection with his indefinite suspension is affirmed, where: 1) neither the Board nor this court may examine the merits of a security clearance suspension; 2) where a court has upheld a suspension, the employee is not eligible to receive back pay; and 3) the Board lacked jurisdiction over petitioner's back pay independent of his suspension.
