In infringement actions involving patents directed to methods for enhancing the stability of prostaglandin compositions, including plaintiff's glaucoma and ocular hypertension drug, the district court's judgments finding that defendant did not infringe certain claims of plaintiff's '287 and '062 patents, but declining to grant defendant judgment as a matter of law of non-infringement as to plaintiff's '383 and '052 patents. are: 1) affirmed in part, where the district court was not clearly erroneous in finding that defendant's product would not infringe the asserted claims of the '287 and '062 patents and the district court did not abuse its discretion in denying defendant's motion to amend for JMOL of non-infringement of the '383 and '052 patents; but 2) reversed in part and remanded, where the district court's invalidity determinations as to the asserted claims of the '287 and '062 patents were not in accordance with law.
