Ancora Technologies, Inc. v. Apple, Inc., 2013-1378

Summary judgment in favor of defendant in a suit in which plaintiff alleged that defendant's products running defendant's iOS operating system infringed plaintiff's patent, which claims methods for verifying that a software program on a computer is not there without authorization, but is licensed to be there, is: 1) affirmed in part, where the district court was correct to reject defendant's challenge to "volatile memory" and "non-volatile memory" as indefinite; and 2) reversed in part and remanded, where the district court incorrectly concluded that the term "program" is limited to application programs, thereby excluding operating systems from the class of programs that the claimed method checks for authorization under a license.
