Solvay, S.A. v. Honeywell International, 2012-1660

Judgment for defendant holding that asserted claim 1 of plaintiff's patent for an improvement to a method of making a hydrofluorocarbon was invalid, is affirmed, where: 1) there was no error in the district court's claim construction; and 2) the district court correctly concluded that engineers working at the Russian Scientific Center for Applied Chemistry (RSCAC) first conceived the invention, which was reduced to practice in this country by defendant's personnel pursuant to the RSCAC's instructions, and did not abandon, suppress, or conceal it.
