In a contract dispute between the federal government and plaintiff, a private company engaged to design and build housing for the military, the decision of the Court of Federal Claim that plaintiff failed to establish liability is vacated and remanded, where: 1) the Court of Federal Claims applied an incorrect standard in determining what plaintiff needed to show in order to prove that the government breached the duty of good faith and fair dealing; and 2) the trial court misinterpreted certain contractual provisions related to plaintiff's good-faith-and-fair-dealing claim.
