Tempo Lighting, Inc. v. Tivoli, LLC, 2013-1140
The Patent Trial and Appeal Board's decision reversing the examiner's rejection of certain claims of defendant's patent for a stair-step lighting apparatus that uses a reflective strip of material to alert users to the edge of a step in darkened or low-light environments is vacated in part and remanded, where: 1) the Board's decision lacks the support of substantial evidence in the record and 2) the Board erred in concluding that plaintiff waived certain arguments.
