Kellogg Brown & Root Services v. US, 2013-5030
The decision by the United States Court of Federal Claims awarding plaintiff recovery of $6,779,762 out of $12,529,504 in costs incurred while providing services to the United States Army in Iraq is affirmed, where the Court of Federal Claims did not clearly err in its finding that plaintiff failed to show that it employed sound business practices and acted as a reasonably prudent business person in accepting a third party's proposed prices for Change Order 1.
