Nazomi Communications, Inc. v. Nokia Corporation, 13-1020
In an action alleging infringement of plaintiff's patents, which describe a hardware-based Java Virtual Machine (JVM) capable of processing stack-based instructions, that also retains the ability to run legacy (i.e., register-based) applications without utilizing the JVM, summary judgment of non-infringement in favor of defendants is affirmed, where the district court did not err in: 1) construing the claims as claiming an apparatus, comprising both hardware and software, capable of practicing the claimed functionality; and 2) concluding that because defendants' apparatuses do not include the necessary software, the accused devices do not infringe.
