United States Federal Circuit

Stueve Bros. Farms, LLC v. US, 13-5021

The Court of Federal Claims properly concluded that the government's conduct in this case did not constitute a taking, where the government never occupied the property by flooding, and thus, had not taken a flowage easement over the portion of their property between the 556-foot and 566-foot flood inundation lines.
