Res-Care, Inc. v. US, 2013-5035

The decision of the U.S. Court of Federal Claims interpreting the Workforce Investment Act (WIA) to allow the U.S. Department of Labor to select a contractor for the Blue Ridge Job Corps Center program through a set-aside for small businesses, is affirmed, where: 1) under the WIA, a selection process confined to multiple small businesses bidding to operate a Job Corp Center (JCC) satisfies the statutory "competitive basis" requirement; and thus, 2) the Claims Court properly construed the WIA to provide DOL the flexibility to use small business set-asides for selecting JCC operators.
