Judgment for defendant on plaintiff's suit alleging that defendant infringed certain claims of plaintiff's patent for intervertebral implants is affirmed, where the district court properly concluded that: 1) the claims were invalid for lack of written description; and 2) defendant failed to demonstrate with clear and convincing evidence that it is entitled to attorney fees under 35 U.S.C. section 285.
