United States Federal Circuit
Intellect Wireless, Inc. v. HTC Corporation, 12-1658
Judgment that plaintiff's patents related to wireless transmission of caller identification (ID) information are unenforceable due to inequitable conduct is affirmed, where: 1) the materiality prong of inequitable conduct is met when an applicant files a false affidavit and fails to cure the misconduct; 2) the district court did not err in concluding that the inventor's revised declaration failed to correct the falsehoods in the original declaration; and 3) the district court did not clearly err in concluding that specific intent to deceive the PTO was the most reasonable inference from the inventor's conduct.
