Summary judgment for defendant that the '122 patent entitled "Intermediate Network Authentication," was not enforceable due to inequitable conduct, is reversed and remanded, where: 1) the Patent and Trademark Office (PTO) Director acted in accordance with law and within his discretion in excusing the delayed payment for maintenance fees due on the patent by the Naval Research Laboratory (NRL); and 2) inequitable conduct was not established.
