Rockies Express Pipeline LLC v. Secretary of the Interior, 12-1055
In a dispute over the interpretation of a series of contracts entered into by plaintiff and Minerals Management Service, a unit of defendant Department of the Interior, the determination of the Civilian Board of Contract Appeals that defendant had materially breached the contract, but that plaintiff was only entitled to damages that had accrued before defendant announced decision to phase out these type of contracts, is: 1) affirmed in part, as to the finding that defendant material breached the contract; but 2) reversed in part as to the decision to limit damages.
